Terms of Service
Last updated November 2, 2026. DRAFT: have this reviewed before launch.
1. The service
Soft Open Leads ("we") compiles publicly available records from the Texas Alcoholic Beverage Commission and delivers them to subscribers ("you") as a lead list, dashboard and email digest. We are not affiliated with TABC or the State of Texas.
2. Information only
Leads are provided as-is for business prospecting. Public records can be incomplete or out of date, and our venue-history matching is automated. You are responsible for verifying information before relying on it, and for complying with every law that applies to how you contact prospects, including CAN-SPAM and the TCPA. We do not provide phone numbers and you agree not to use the service for robocalls or unsolicited texts.
3. Subscriptions, trials and cancellation
Plans renew monthly or yearly until canceled. New subscriptions include a free trial; cancel before it ends and you won't be charged. You can cancel any time from Settings, and access continues until the end of the paid period. Fees are non-refundable except where the law requires otherwise.
4. Seats and territories
Shared seats are limited per county. Exclusive territories mean no other Soft Open subscriber receives that county's leads while your exclusive plan is active. The underlying records remain public, and we can't stop others from obtaining them elsewhere.
5. Acceptable use
Your account is for your agency's internal use. Don't resell, republish or bulk-redistribute the data, share your sign-in, or attempt to access other members' data or disrupt the service.
6. Liability
To the fullest extent the law allows, our total liability for any claim is limited to the fees you paid in the three months before the claim, and we are not liable for lost profits or indirect damages.
7. Changes
We may update these terms and will email you about material changes at least 14 days before they take effect.
